A man previously charged with possessing child exploitation material is back before the court after being caught twice driving with drugs in his system.

Anthony George Trevelyan, 44, pleaded guilty when he appeared in the Southport Magistrates Court on Monday to a slew of charges including possessing dangerous drugs, possessing pipes, and possessing property suspected of having been used in connection with the commission of a crime.

The court heard Trevelyan was pulled over by police conducting patrols at Runaway Bay around 10.46pm on March 13.

He submitted to a roadside breath test and returned a positive result for methamphetamine.

Police detained Trevelyan for a further search of his car and found a black sunglasses case with a used glass meth pipe, several clip seal bags containing less than one gram of methamphetamine, a flip knife and two foreign driver’s licenses.

On a second occasion, Trevelyan was pulled over while driving on Beaudesert Nerang road, Nerang around 12.50am on May 18.

He again tested positive to methamphetamine.

The court heard Trevelyan was convicted and sentenced to an 18 month suspended sentence in March 2024 at Beenleigh District Court for possessing child exploitation material.

He was still subject to the suspended sentence at the time of both offence dates.

Acting Magistrate Sarah Thompson told Trevelyan he had breached his suspended sentence by committing offences that were punishable by imprisonment and said she would need to commit him to the Beenleigh District Court to be dealt with.

Breaching a suspended sentence can result in serving time in actual custody, the sentence being extended or additional penalties being imposed.

Ms Thompson told Trevelyan it was unlikely he serve the actual period in custody because the nature of the offence was different but recommend he speak to Legal Aid.

Trevelyan, who represented himself in court, said he had been using the knife while working in demolition.

He told the court he was also working for a tow truck company at the same time, the licences had come from clearing out written-off vehicles and there was no malice or harm.

When asked by Ms Thompson about the drugs, he said he needed to get help.

“I support myself and a lot of rehabs are quite expensive,” he said. “So I need to find one I can get into or win the lotto.”

He told the court he had been suspended from driving since May.

Ms Thompson took into account Trevelyan’s guilty pleas,

She said Trevelyan had accepted he had some mental health issue he needed to deal with and said it appears he was using drugs in part to self medicate.

She sentenced him to a six month probation order with special conditions in relation to a medical, psychological and psychiatric treatment.

He was disqualified from driving for two months and a conviction was recorded.

He was committed to the Beenleigh District Court to be sentenced over breaching his suspended sentence.

Ms Thompson granted Trevelyan bail, and asked if lawyers represented him at the District Court.

Mr Trevelyan said he had represented himself.

“Lawyers are even more expensive than rehab,” he said.

Ms Thompson told him he might be eligible for Legal Aid now.
