A man accused of a terrifying home invasion in Grovedale last week was released from jail only two days before the alleged crime, a court has heard.
Nathan Elbourne, of Belmont, fronted the Geelong Magistrates Court on Monday for a bail application and filing hearing.
The 20-year-old has been charged with attempted home invasion and recklessly causing injury.
About 11.30pm on January 3, Mr Elbourne and two co-accused, a 25-year-old Ararat man and a 12-year-old boy, allegedly attempted to gain entry into a home on Church St in Grovedale.
The male occupant of the house allegedly confronted the trio and a scuffle ensued.
The court heard the occupant allegedly stabbed one of the trio in the back before he was allegedly assaulted.
The trio allegedly fled the scene but were later arrested.
The court heard Mr Elbourne was released from jail on January 1 this year before he allegedly committed the offences two days later.
None of the trio have made admissions as to why they allegedly committed the offences.
The Power in You Project peer worker Kieran Kennedy said Mr Elbourne had re-engaged with the support agency’s services the day after his release and it could provide up to 10 hours of support per day to him, due to him not accessing his funding for the service while incarcerated.
Mr Elbourne’s lawyer said his client had a “longstanding history” with support services.
“He now has support through the NDIS … and from the Power in Your Project,” he said.
“He has what he didn’t have for a long time, which is a place to stay with his aunty.”
The court heard Mr Elbourne was placed on a community corrections order with a disability plan following his release and had been diagnosed with post-traumatic stress disorder.
“He is an extremely vulnerable young person,” his lawyer said.
Police prosecutor Kylie Jane said Mr Elbourne posed an unacceptable risk to the community given the alleged offending occurred two days after he was released from a “significant” time in custody.
“You’re not going for a social visit at 11.30pm,” she told the court.
“Mr Elbourne then assaults (the occupant) who had to undergo scans for potential head injuries.”
Ms Jane told the court Mr Elbourne had made admissions to punching the occupant four times as hard as he could … and smashing windows with a bottle.”
Magistrate Franz Holzer refused Mr Elbourne’s bid for bail and said he posed an unacceptable risk to the safety and welfare of the community.
A brief of evidence will need to be handed up by February 17 and Mr Elbourne will front court again on April 8 for a committal mention.
