Dr Shafiul Milky’s rape and sex assault trial discharged

The trial into an Ocean Grove doctor accused of rape and sexual assault will be restarted after a judge discharged the jury.

The jury in the trial of a doctor who allegedly sexually assaulted or raped six of his female patients has been discharged.

The County Court heard a juror in the trial of Ocean Grove general practitioner Dr Shafiul Milky has a connection with someone in the investigative team, meaning the hearing will be restarted.

The investigator’s name was not provided to the jury before Wednesday morning when the conflict was told to the court.

Both defence and prosecution were open to the discharge.

Judge Felicity Hampel said it was possible a new jury could be empanelled soon.

Dr Milky has pleaded not guilty to 15 charges, including indecent assault, sexual assault and rape.

The allegations took place between 2012 and 2019 while Dr Milky was working at the Ocean Grove Peninsula Family Medical Centre and as a doctor with the National Home Service.
