Australia's Court System

A drug-addled man who went on a “downright bizarre” crime spree in Ocean Grove – including trying to rob a man by asking if he wanted to see a gun – was jailed for 109 days on Monday but walked free due to time served.

Daymion Guru, 21, was on bail and staying at a short-term rental property at Normandy Cres on August 28 and 29 last year when he damaged property, tried to break into homes while homeowners slept and tried to rob a man walking his dog.

The County Court heard Guru had drunk alcohol and was on ice and Xanax, on August 28 last year when he confronted the man walking on Belle Vue Drive about 10pm, lowered his pants to reveal a ratchet wrench and asked for money.

When his demands weren’t met, Guru asked the man three times, “Do you want to see a gun?”, the County Court heard.

After Guru was arrested in the early hours of August 29, police said he was rambling and incoherent when they tried to interview him.

He later told police he chased the man for “like five minutes” because he wanted “nice things”, and didn’t remember much from the night because he was drug affected.

Guru also said a knife found protruding from a wall at the short-term rental was thrown by him for “practice.”

About an hour after the attempted armed robbery, Guru returned to a backyard in Fontaine Court, Ocean Grove, where he had been sprung by a homeowner about 18 hours earlier.

On the earlier occasion, Guru told the homeowner – who was sleeping inside with her four children and woke when he tried to open a door – he was looking for his dog.

“I am just looking for my dog. If you find it, just call Daymion,” Guru said.

Guru’s crime spree of eight incidents committed in less than 24 hours included breaking into a pottery studio at a home in Cantal Court where he scribbled “indecipherable text and symbols”, stealing property from other homes, and trying to start a car using roof rack keys.

Judge Gavan Meredith, who sentenced Guru to an 18-month community corrections order, described the offending as “unplanned, chaotic and at times downright bizarre”.

Judge Meredith said Guru’s rehabilitation had progressed since he was released from jail in December last year.

“I accept that you are now appropriately remorseful,” Judge Meredith said.

“In your case, given your significant progress which you have made, I assess your rehabilitative prospects as positive.”

Guru’s community corrections order will require him to complete 100 hours of unpaid community work, be supervised by Corrections Victoria for 12 months, and complete testing and treatment for drug and mental health issues.

Guru pleaded guilty to theft, attempted armed robbery, trespassing with intent to steal, and committing offences while on bail.
