The Territory’s former road safety boss accused of letting his son out of a booze test at a music festival is fighting to see the alleged evidence against him.
A lawyer representing former NT Police Road Policing Division Superintendent Daniel Shean appeared before Darwin Local Court Judge Greg MacDonald on Wednesday, three months after the ex-top cop was charged with attempting to pervert the course of justice.
This masthead understands there was an internal investigation into allegations that Mr Shean misused information during a random breath test involving his son following the Bass in the Grass music festival on May 18.
The former top cop has previously wholeheartedly denied the allegations against him, and his son is not accused of any wrongdoing.
Mr Shean resigned from the police force in August, citing mental health and family issues.
The 56-year-old was formally charged in October, with a police media release failing to highlight that the alleged offending occurred while he was a serving officer.
On Wednesday Mr Shean’s lawyer said she was seeking a brief service order, pushing for the investigating officer to hand over the statements and evidence against her client.
Mr MacDonald approved the application and adjourned the matter for a preliminary examination mention on February 26.
