A TINDER date allegedly went horribly wrong with a woman left “shocked and confused” and a man charged with rape.

Kamaldeep Singh, 36, has pleaded not guilty to two counts of rape with the trial starting in Cairns District Court on Wednesday.

The court heard Mr Singh and the woman agreed to meet and go bowling and the following day, June 28, 2020, they agreed to go to lunch at Port Douglas.

Crown prosecutor Tegan Grasso said Mr Singh persisted despite the woman saying “no” repeatedly.

“Mr Singh would not take no for an answer,” Ms Grasso said.

“He stopped listening to her entirely.”

A video recording of the woman giving her account to police was played to the jury.

The woman said she’d made it clear on Tinder she was seeking “people to hang out with, not hook ups”.

She said after the date, Mr Singh asked to come inside her unit and she reluctantly agreed to “show him around”.

He tried to get her on the couch and kiss her and she said “I don’t want to do any of that”.

Mr Singh offered to massage her and she said no, but he insisted it would not be sexual.

He asked her to turn over so he could massage her shoulders, she said.

“He didn’t go for my shoulders, he went right for my breasts, I said ‘this is not okay, this is not what I want, can you please stop,’” she said in the recording.

Mr Singh undressed himself and laid on her and briefly performed oral sex on her, the woman said.

“I kept telling him to stop, he put his fingers down my pants, I was shocked this was even happening, he tried to put his penis in,” she said.

“He came around the bed and put his penis in my face …. He was trying to spread my legs and I was trying to cross them,” she said.

“I started to raise my voice, I said ‘can you please get off, I am not having fun’”.

The woman said she later texted Mr Singh “no means no” and he responded “I don’t know what your problem is, it was just a kiss and cuddle”.

Part of a video of a police interview with Mr Singh was played to the court.

He told the police officer “I did nothing wrong, and it was all mutual”.

“I went to her place for a bit of a chat … we kissed, she kissed me back, she said ‘you’re pretty sexy’, that kind of stuff,” Mr Singh said in the interview.

Defence barrister James Sheridan cross examined Constable Luck about whether there was forensic testing at the scene.

He asked if fingernail scrapings were taken from Mr Singh and Const Luck said not that she was aware of.

Const Luck said the woman told her she had washed the sheets.

The trial before Judge Dean Morzone, QC, is expected to continue for three to four days.
