Two separate drink-driving offences put Toowoomba man off road

Before the court could deal with him for the first drink-driving offence, he blew an even higher reading on the second occasion.

A 47-YEAR-OLD man has been ordered off the road for the next 12 months after pleading guilty before Toowoomba Magistrates Court to two separate drink-driving offences.

Terrence Noel Duncan had been pulled over by a static police random breath testing unit while driving in St George about 5pm, August 23, police prosecutor Narelle Lowe told the court.

He blew a breath/alcohol reading of 0.081.

However, before that incident could be dealt with by the court, Duncan had again been booked for drink-driving in Toowoomba.

Senior Constable Lowe said the defendant had been arguing at home with his partner about 7.35pm, October 27, when he had driven off to get away from the situation.

His partner had called police who found him lying on the back seat of his car parked in the car park of Clifford Gardens Shopping Centre.

Initially telling police he had walked to get his car from the car park, the 47-year-old then confessed he had been driving the vehicle.

This time he returned a breath/alcohol reading of 0.144, Snr Const. Lowe said.

Duncan pleaded guilty to both drink-driving offences.

His solicitor Michael Corbin said his client had two previous drink driving offences but both were outside the five year term.

On the second occasion his client had been “sleeping it off” in his car, he said.

Magistrate Howard Osborne fined Duncan a total $1050 and disqualified him from holding or obtaining a driver’s licence for 12 months.
