Toowoomba driver gets away from cops but not from the court

He refused to give a sample of breath for testing then ran away from cops but the court caught up with him.

HE MAY have successfully run away from police but this 21-year-old was not escaping Toowoomba Magistrates Court.

Joakin Mirerekano had been found by a police patrol sitting in the driver’s seat of a car parked in Toowoomba’s CBD about 1am, November 17, talking to a passenger.

Getting out of the car and approaching police, he produced his driver’s licence but refused to give a sample of breath after police saw a half bottle of liquor in the centre console, police prosecutor Narelle Lowe said.

Despite numerous warnings, the 21-year-old refused to give a sample of breath and then ran away.

Two days later he attended the police station.

He pleaded guilty to failing to provide a sample of breath and obstructing police.

Duty solicitor Ryan McCullough told the court his client claimed he hadn’t been driving but had been sitting in the driver’s seat.

He had been frightened and confused and had run off, he said.

The Tanzanian born 21-year-old had lost his job in Brisbane due to COVID but he hoped to get that job back soon, Mr McCullough said.

Magistrate Howard Osborne fined Mirerekano $800 and disqualified him from driving for six months.
