A TOOWOOMBA man who had already spent Christmas and New Year behind bars after a suitable bail address couldn’t be found for him remains in custody after appearing in the city’s Magistrates Court today.
The 45-year-old man was taken into custody on Christmas Eve on a domestic violence charge arising from an alleged argument with his partner at their Toowoomba residence.
Unable to return to the marital home due to a no contact condition of his bail, the man remained in the watch house while duty solicitor Brad Skuse contacted potential bail addresses nominated by his client.
“There’s no room at the inn”, a police prosecutor told Toowoomba Magistrates Court on Christmas Eve after making a phone call regarding a defendant’s nominated bail address, leaving him to spend Christmas Day in custody and to see in the New Year from behind bars.
The 45-year-old, who cannot be named due to domestic violence orders, appeared in court via video link on Monday seeking to be released from custody.
However, Mr Skuse told the court the contact numbers that his client had put forward were not answering but he would continue to try and contact those people in the hope of securing his client a suitable bail address.
Acting Magistrate Roger Stark therefore remanded the man in custody and adjourned the defendant’s bail application to Thursday this week while Mr Skuse made further attempts to secure a suitable bail address.
