Despite further counts of spitting on cops, accused granted bail

DESPITE being charged with further counts of seriously assaulting police officers, a 42-year-old Wyreema man has been granted bail.

Michael James Mostyn, 42, was taken into custody on Sunday after he allegedly became involved in an altercation with police on Greenwattle St.

Police claim Mostyn had kicked one officer in the head and kneed another in the head, leaving both with concussion like injuries.

He is further accused of spitting in the face of a police sergeant when taken to the watch house.

Mostyn was taken to Toowoomba Hospital and was not in the city’s Magistrates Court on Monday when his charges, which included three counts of serious assault of police causing bodily harm, two other counts of serious assault of police, and one each of public nuisance, obstruct police and trespassing, were mentioned.

He was remanded in the custody of police with his case adjourned to the same court yesterday where he appeared by video from the watch house as duty solicitor Kyna Morice made an application for bail on his behalf.

Police prosecutor Shelby Larcombe objected to the bail application, telling the court that while Mostyn was at the hospital and about to be transported back to the watch house on Tuesday, he had again allegedly spat on police.

She said because of the earlier alleged incidents of his spitting at police, the constable and senior constable who attended the hospital had been wearing safety glasses but police claimed he had spat in the constable’s face and had spat in the direction of the senior constable but it was unknown if the saliva had struck her.

He had yelled abuse at medical staff and police at the hospital and was now on 14 charges including seven counts of serious assault of police, she said.

Ms Morice said her client could abide by a number of conditions should he be granted bail.

Acting Magistrate Lisa O’Neill granted Mostyn bail on condition he live with his partner at Wyreema, report to police three times a week and abstain from drinking alcohol and to submit to random breath testing by police with his reading to be zero.
