After being pulled up by police, a 21-year-old repeat offender gave a mate’s name only to discover his friend was on a return to prison warrant and was taken into custody anyway.

Tyrese William Anthony Weribone appeared before Toowoomba Magistrates Court on Monday via videolink from prison on a charge of possessing a dangerous drug.

The 21-year-old told the court he didn’t have a lawyer as the solicitor he had had withdrawn due to a conflict.

Weribone had been sentenced to a jail term in July 2022 after pleading guilty to being part of a group which robbed a 14-year-old boy on a Toowoomba CBD street.

He told the court on Monday that he was in jail after a return to prison warrant was executed and that he wanted to plead guilty to this charge of possessing a small amount of cannabis “to get it over and done with”.

Police prosecutor Anita Page told the court Weribone had been a passenger in a car pulled over by police on August 4.

He gave a false name to police but that name turned out to be on a return to prison warrant so Weribone was taken into custody, she said.

He was found to have 2g of cannabis on him and he had then come clean about his true identity, the court heard.

Magistrate Kyna Morice noted by Weribone’s criminal history he didn’t have much drug offending.

“I smoke weed when I get out, yeah,” he told Ms Morice.

Ms Morice noted Weribone had been sentenced to seven months in jail, to be suspended after four months, by the court on August 28 for a series of offences.

Ms Morice said had Weribone been sentenced at that time for the cannabis possession he would not likely have received any further punishment so she convicted him but ordered no further penalty.
