A magistrate has warned a Toowoomba man if he did not stop committing acts of domestic violence against the mother of his children, it was likely he would kill the woman.

The details of a Toowoomba man’s abhorrent acts of domestic violence against the mother of his children remain hidden, however that did not stop a magistrate from sending him to jail.

A Toowoomba court heard just days after Tyrone Michael Thomas Whittaker was released from prison in November 2023, he brutalised the woman, leaving her bloody and bruised.

Although the woman did not make a police report, officers took photos of her facial injuries.

The court heard Whittaker, who suffers from PTSD, had a lengthy criminal history which contained numerous serious assaults against people, including the same woman.

Two days before he assaulted the woman, the court heard police took Whittaker to hospital on November 5, 2023, for a mental health assessment.

While there, he twice attacked a security guard in his 60s, with no warning or provocation.

Magistrate Clare Kelly said both assaults were serious, however his history of domestic violence was particularly concerning.

“Needless to say at some point Mr Whittaker, if you continue in the way that you are, you’re likely to kill a person and that person is likely to be (her) unless what you say about the end of the relationship is true,” she warned.

“Unfortunately because of (your former partner’s) lack of co-operation the way in which you assaulted her, or the manner in which that occurred had not been revealed to police.

“It would seem that from the photos… there were significant facial and head injuries that saw her bleed significantly.

“I’m sentencing you on the basis that the assault was of a significant nature.”

Whittaker pleaded guilty to three counts of assault and was sentenced to an 18-month jail term.

The 154 days he spent in pre-sentence custody was taken into consideration, but it was not declared as time served.

Ms Kelly said by law she was required to set a parole eligibility date, which was May 7, 2024.

She said it was up to the parole authority “when, if, and how,” he would be released.

“I suspect given your lengthy and violent history, the parole authority will be acting very cautious about when you are released,” she said.

His full time release date is June 28, 2026.
