A Toowoomba man who denied strangling his ex-partner during a moment of jealous rage has been found guilty of the serious domestic violence charge.

Following a three-day trial at Toowoomba District Court, a jury found Kurtis Charles Blewitt guilty of one count of strangulation in a domestic violence setting.

There was a domestic violence order in place at the time of the offence, which occurred at the woman’s Toowoomba home on a Monday morning in August 2022.

The pair were separated at the time, but Blewitt had not accepted the relationship had ended and tried to keep track of what she was doing and who she was talking with.

Crown prosecutor Arielle Spiteri told the court the violent crime Blewitt committed against the mother of his child was not “out of the blue,” noting he exhibited coercive control.

In the lead up to the escalation of his offending, Ms Spiteri said the young man was known to fits of jealous rage, repeatedly contacted the woman, and smashed her phone when she wouldn’t give him the passcode.

On the morning of the strangulation, the court heard the woman reluctantly let Blewitt into her home after telling him not to come over.

He demanded to see her phone, but when he didn’t get his way, he pushed her onto a bed and strangled her with such force she could not breathe.

Blewitt then told her to kill herself.

After he let go, the woman fled to the bathroom and took photos of the large red marks his hand had left on the side and front of her neck.

Judge Benedict Power KC adjourned Blewitt’s sentence to March 14.

Blewitt was granted bail to live at his parent’s farm at Gunnedah in New South Wales.

In Queensland, there is no mandatory imprisonment penalty for those convicted of strangulation.

The maximum penalty is a seven-year jail term.
