A 23-year-old Lockyer Valley man accused of a serious assault against a 73-year-old man has had his case adjourned in Toowoomba Magistrates Court.

Stoney Izak Allen Graves has been held in custody since his arrest in May for the alleged incident and was not required to be in court for the brief mention of his matters on Thursday.

Police claim Mr Graves was drinking at a pub in March when he was allegedly told the 73-year-old man had complained to police about Mr Graves’ driving.

It is further alleged the 23-year-old then went to the older man’s home and assaulted him. As a result the 73-year-old was taken to hospital suffering a collapsed and bleeding lung, fractured and dislodged ribs, and a small spine fracture.

Mr Graves has not as yet been required to enter any pleas to the charges which include grievous bodily harm and obstructing police arising from the alleged assault or to unrelated traffic matters of driving an uninsured, unregistered vehicle and driving a defective vehicle.

Mr Graves’ solicitor Nathan Bouchier, of Bouchier Khan Lawyers, told the court on Thursday he had received the police brief of evidence but a doctor’s statement and medical reports remained outstanding.

Magistrate Louise Shephard therefore remanded Mr Graves in custody and adjourned the case for committal mention back in the same court on June 29.
