Following a day of drinking, a Toowoomba man had planned to stay with his brother until he got sick in the bed.

Rather than sleep in his car, Ryan Alexander Duncan made the unfortunate decision to drive home.

Toowoomba Magistrates Court was told police conducting patrols in Drayton saw the 25-year-old pull into the carpark of a 7-Eleven store about 11.30pm on June 7, 2022, and stopped him for a random breath test.

Police prosecutor Rohan Brewster-Webb said Duncan returned a reading of 0.177, more than three times the legal limit. In court on Monday Duncan pleaded guilty to driving while under the influence of liquor.

Duncan’s solicitor Michael Corbin said his client had intended to stay with his brother but was tossed out after he got sick in the bed.

Duncan was fined $1200, and disqualified from driving for 12 months.
