IN COURT: Ross Andrew Burke will remain in custody after his case was mentioned in Toowoomba Magistrates Court.

A 51-year-old Dalby man charged with causing grievous bodily harm to an Oakey man remains in custody after his case was adjourned.

Ross Andrew Burke was not required to be in Toowoomba Magistrates Court for the mention of his case on Tuesday but his solicitor Steve McCrohon, of Cullen Lawyers, obtained an adjournment.

Mr McCrohon said he had just received the police brief of evidence and needed an adjournment to go through the brief and take instructions.

Police claim Burke had been driven by a friend from his Dalby home on Saturday, August 7, about 8pm to Oakey where it was alleged he assaulted a 51-year-old man at his home.

The complainant allegedly sustained serious head and facial injuries and was taken to Toowoomba Hospital before being flown to the Gold Coast University Hospital.

Burke has not been required to enter any plea to the charge and was refused bail on his first appearance in court on the charge.

Magistrate Graham Lee remanded Burke in custody and adjourned the case for mention back in the same court on November 16.
