The 35-year-old was drunk and agitated when police arrived at the caravan park he was staying at, but the Wilsonton man made matters worse for himself when he moved his car in front of police who then breath tested him. See what he blew.

Simply moving his vehicle from the yard onto the nature street outside was enough to cost a Wilsonton man a large fine and a six-month driving disqualification.

Robert James Lee McLeod and his family had been living in a caravan parked at a Wilsonton residence because he couldn’t secure rental accommodation, Toowoomba Magistrates Court was told.

However, when about 8.45pm he got into an argument with his landlord brother-in-law, police were called to the disturbance, police prosecutor Rohan Brewster-Webb told the court.

The drunk and agitated McLeod “got into the faces” of police before grabbing his keys and driving his vehicle out onto the median strip, he said.

Asked by police why he was driving after drinking alcohol, the 35-year-old replied that he was not driving on the road so there was no problem.

When a breath test proved positive to alcohol, McLeod was arrested but became agitated and struggled with police leading him to the police vehicle where he was handcuffed and forcibly placed into the car, Mr Brewster-Webb said.

At the police station, McLeod returned an alcohol reading of 0.177, the court was told.

McLeod pleaded guilty to driving while under the influence of liquor and obstructing police.

His solicitor Alysha Jacobsen, of Bouchier Khan Lawyers, told the court because McLeod had been drinking throughout the day, her client’s partner had been driving.

However, when the argument took place he had wanted to move the caravan to another site and had decided to drive the car onto the median strip to get it out of the way, she said.

McLeod was a FIFO worker and worked in Darwin, earning a good living for his family, she said.

Magistrate Kay Philipson noted McLeod had previous alcohol fuelled offences and fined him $750 and disqualified him from driving for six months.
