Prosecution withdraws charges against Darling Downs Hospital and Health Services, related to Oakey Aged Care

Aged care workers ‘deserve every single cent’ of recent win

Prosecutors have withdrawn all charges against Darling Downs Hospital and Health Service in Toowoomba Magistrates Court on Monday.

On the first day of the trial on July 10, lawyers for DDHHS pleaded not guilty to three counts of failing to comply with a health and safety duty allegedly related to incidents at Oakey Hospital Nursing Home.

Opening the prosecution case, barrister Glen Rice, prosecuting on behalf of Workplace Health and Safety, said the alleged incidents dated back to 2019 and 2020 and included alleged deficiencies in maintaining the safety of medical and other staff at the Oakey facility.

However, at the beginning of what was expected to be the third day of the hearing in court on Monday, the prosecution applied to have all charges withdrawn.

Magistrate Louise Shephard therefore discharged DD Hospital and Health Service bringing to a close the prosecution.
