Midnight cruise lands Toowoomba hoon in court for costly appearance

A Toowoomba revhead’s new car has proved more costly than first anticipated after he was caught speeding 40km/h over the limit.

A Toowoomba hoon’s hip pocket has been hit with a double whammy as the young man foots the bill for a number of driving infringements he committed in his new Ford Falcon.

Deakin Daryl Keith Gainey fronted Toowoomba Court on Tuesday, October 1, and pleaded guilty to driving unlicensed.

The court was told Gainey lost his licence on April 23 after he was caught speeding more than 40km/h over the speed limit.

Toowoomba police then intercepted Gainey driving unlicensed through Wilsonton Heights along Tor St just before 1am on August 10.

Gainey instructed his lawyer Michael Corbin he was confused about the status of his licence after receiving three different notices from the Department of Transport and Main Roads.

Mr Corbin said Gainey was on a payment plan with the State Penalties Enforcement Registry where he paid $60 a week, however Gainey planned to increase the amount.

“That will be increasing in November once he’s finished paying off a personal loan which happened to be for the motor vehicle he was driving,” he said

He said the born and raised Toowoomba man could pay a fine as he earnt $1000 a week working for a manufacturing company.

“The disqualification will have some impact on him given his youthful age and circumstances,” he said.

Magistrate Michelle Dooley told Gainey it was his responsibility to check in with the Department of Transport and Main Roads about the status of his drivers licence.

“You were aware that you exceeded the speed limit by more than 40km/h which is an eight points demerit offence,” she said.

Ms Dooley said she would disqualify Gainey’s licence for the mandatory minimum period of six months. No conviction was recorded.

She also added $550 to his SPER debt.
