A father of three who sold drugs out of the family’s Toowoomba home has been sentenced to two years in jail.

However, in recognition of his self rehabilitation before and after his arrest, Kyle Michael Csallo was released on immediate parole.

Crown prosecutor Nicole Friedewald told Toowoomba District Court a police search of Csallo’s home in February 2021 had found a cannabis plant growing in the back yard along with 47g of cannabis leaf packaged in bags.

Yet it was what was found on the 31-year-old’s mobile phone that told of the full extent of his offending.

Ms Friedewald said police found messages dating back to 2017 to the supply of cannabis which he had done sporadically over the years since.

Csallo’s offending escalated to the point he trafficked cannabis over a three-month period which only came to halt when police searched his home, she said.

Although the trafficking period was of a relatively short period, it was the Crown case Csallo had a customer base of about 22 people and he had supplied the drug on at least 96 occasions in that time period, Ms Friedewald submitted.

It was accepted by the Crown Csallo was selling the drug to support his own habit but possibly also for a small profit, she said.

Csallo pleaded guilty to 10 counts of supplying a dangerous drug and one each of possessing, producing and trafficking a dangerous drug.

His barrister Wes Seewald, instructed by MacDonald Law, told the court his client had sought counselling for his alcohol and drug issues days before police arrived with a search warrant.

His client was working and through a reference put before the court his employer spoke well of him, he told the court.

Csallo had co-operated with police and made “frank and candid admissions”, he said.

Judge Alexander Horneman-Wren said if he sent Csallo to jail he would lose his job and exit jail unemployed.

However, he was scathing of the father of three for selling drugs from the family home.

“How horrible for them,” he said.

“You’ve got three young children, if you can’t be motivated to turn your life around for your own sake, do it for them.”

Telling him he was now a “prisoner”, Judge Horneman-Wren sentenced Csallo to two years in jail but ordered he be released on parole immediately.
