Jesse Nathan Ellevsen faces Toowoomba Magistrates Court for committing public nuisance, trespass

Police found a man wandering the streets in just his shorts, with his mother chasing after him, following his attempts to get a neighbour to fight him.

After spending the night in custody, a Cambooya man has copped some hefty fines for attempting to start a fight with a neighbour, drink driving and failing to appear in court.

Jesse Nathan Ellevsen appeared in Toowoomba Magistrates Court from the watch house where he pleaded guilty to commit public nuisance, trespass, driving over the general alcohol limit and failing to appear in accordance with an undertaking.

The court was told that police were called to an address in Cambooya about 9.30pm on November 10, 2021.

Ellevsen was found walking down Weebah Place dressed only in shorts and was non-compliant with police efforts to speak with him, police prosecutor Anita Page said.

“He was being followed by his mother who was attempting to persuade him to stop to speak with police,” she said.

The 28-year-old was eventually confronted by police and placed under arrest as they conducted investigations into an early street disturbance.

Ms Page told the court that witnesses reported Ellevsen went to a house on Weebah Place and “knocked violently” on the front door, demanding the male occupant come outside to fight.

“The witness has refused to open the door, stating that he had small children inside the house,” Ms Page said.

Ellevsen was then seen to pick up a large rock and motion to throw it through the front window while yelling “I don’t give a f--- if there’s kids in there”.

The court was told another witness then told Ellevsen to drop the rock, before he climbed a fence to access the neighbour’s yard to continue to yell at the witness to come outside for a fight.

The occupant of the first house eventually did go outside and the Ellevsen tried to fight him in the middle of the street before it was broken up by a third witness, at which point Ellevsen tried to leave the area.

Ms Page said Ellevsen was stopped by police at 9.20pm on December 7, 2021, where he blew 0.072 after drinking two beers and two sips of his partner’s cocktail.

A warrant was issued after Ellevsen failed to appear in court in March, and on April 25 he was arrested.

Ellevsen’s solicitor Brad Skuse said his client had heard upsetting news on the evening of November 10 which had resulted in the altercation, which had been stopped before it “got out of hand”.

Mr Skuse said his client, a heavy machinery driver working on oil rigs, had been working out of town which was why he missed his court date.

Ellevsen was convicted and fined $1750, as well as disqualified from driving for three months.
