Jeremy Brock Biber pleads guilty in Toowoomba Magistrates Court for four counts of failing to reply with reporting conditions

After previously being convicted of possessing child exploitation material, a Toowoomba man has again faced court for getting a new phone and using social media to access images of young girls.

A convicted child sex offender has once again faced court after he was busted by police with a phone and accessing social media, breaching the conditions of his reporting requirements.

Toowoomba Magistrates Court on Friday was told police attended Jeremy Brock Biber’s address for a compliance check on March 16, 2022, with the 27-year-old subject to reporting conditions under the Child Protection Act.

During the check police prosecutor Senior Constable Chris Willson told the court officers found Biber had a new phone and social media accounts, including Instagram but had not reported them to police.

An investigation of Biber’s phone revealed that he had joined a social media platform aimed at young girls, and Instagram accounts posting images of girls aged under 10 in swimwear and gymnastic uniforms.

“Police spoke to (Biber) who became quite upset at the possibility that he had breached his reporting obligations, admitted that he had a problem as far as accessing and viewing the type of material they had located on his phone and that he was not getting the help he needed from his current therapist,” Senior Constable Willson said.

The court was told Biber had faced Toowoomba District Court in June 8, 2020 where he pleaded guilty to four counts of a failure to comply with reporting obligations, one count of possessing child exploitation material and one count of using a carriage service to access child pornography material.

Police found him in possession of 4300 child exploitation images on two separate occasions, which saw him sentenced to an effective 2.5 years in jail, and he was released from custody on parole in February, 2022.

In court on Friday, Biber pleaded guilty to four counts of failing to comply with reporting requirements.

Biber’s solicitor Shane Hough said his client had intentions to live with and care for his elderly grandparents upon his release, and had employment prospects in the future in the cleaning industry.

Mr Hough said Biber had been seeing a psychologist but had “no insight” into his offending, and that he was distressed with his reoffending.

Noting that the offences were committed while on parole, but that Biber had spent 149 days of pre-sentence custody in protective custody, magistrate Louise Shepherd declared the time served as punishment for the offences and set an immediate parole eligibility. Biber was also sentenced to 15 months probation.
