Full list of Toowoomba drink, drug drivers in court August 2023

Here’s a list of people who lost their licence this month, after fronting Toowoomba court and pleading guilty to drink or drug driving.

Dangerous Qld motorists caught on camera

Multiple Toowoomba drivers were found guilty of drink or drug driving and had their licence taken off them at the Toowoomba Magistrates Court this month.

While many others fronted court on pending drink and drug driving charges, here’s a list of those who were sentenced:

Methamphetamine driving offence

A 42-year-old Toowoomba man, Daniel John Reardon, was caught driving home from a New Year’s Eve gathering unlicensed, and with meth in his saliva.

At Toowoomba Magistrates Court, Reardon pleaded guilty to drug driving, and driving while disqualified by a court order.

Prosecutor Bettina Trenear said Reardon had 11 pages of traffic history which included a number of drink-driving and unlicensed offences.

Solicitor Joe McConnell said at the time of the offence the former FIFO worker was at “rock bottom” following the death of his wife, unborn child, and sister.

He was sentenced to a four-month jail term suspended for 12 months, and had his licence disqualified for 30 months.

Drink-driving offences

Stacy Patrick Moxham

Wyreema man Stacy Patrick Moxham fronted a Toowoomba court for doing a burnout while he was grossly intoxicated.

Police prosecutor Bettina Trenear said police were called to the man’s home on July 23 for an unrelated matter when they found Moxham sitting in the front yard.

He told officers he had not driven the car and had only moved it from the street, but officers could smell burnt rubber and also saw pieces of it in the wheel wells.

Ms Trenear said there were also fresh tire marks on the road, and officers reported the engine bay was quite hot.

The court heard Moxham’s breath test reading was 0.207, and he became agitated and aggressive towards the officers who were forced to physically detain the man.

Ms Trenear said Moxham refused to get in and leave the police car, forcing the officers to physically move the man on multiple occasions.

His aggressive behaviour towards police continued at the watch house.

The court heard following the incident, the pest controller organised counselling sessions to help with his behavioural issues.

At Toowoomba Magistrates Court on Monday, August 28, Moxham pleaded guilty to driving under the influence of liquor, unlawfully making noise and smoke with his car, and obstructing police officers.

Moxham was fined $1000 and disqualified from driving for 6 months.

A conviction was recorded.

Drink drivers who had no conviction recorded

Ashley Allen Dynon

A Toowoomba Magistrates court heard Ashley Allen Dynon crashed his car while under the influence of alcohol.

Police prosecutor Kinsley Weir said a sample of the 55-year-old’s blood showed Dynon had a blood-alcohol level equivalent to 0.15, which is three times the legal blood alcohol limit.

Mr Dynon told officers the last thing he remembers from June 16, is leaving an AA meeting at about 7.30pm.

The crash accoutred at 10.30pm.

On August 21, Dynon pleaded guilty to driving while under the influence of liquor and to driving without due care and attention.

He was fined $1200 and disqualified from driving for six months.

No conviction was recorded.

Andrew Jason MacDonald

Andrew MacDonald fronted Toowoomba court after he was caught driving with a blood alcohol concentration of .139.

The court heard the young man decided to go for a lap around his block after drinking two glasses of scotch because he had had a bad day.

Police prosecutor Bettina Trenear said MacDonald was pulled over at 10.35pm in Toowoomba on August 7.

MacDonald told the court his mother had to drive to Toowoomba from the Lockyer Valley to drive him around for things like grocery shopping.

At the Toowoomba Magistrates Court on Monday, August 28, MacDonald pleaded guilty to driving over the middle alcohol limit.

He was fined $700 and disqualified from driving for three months.

No conviction was recorded.

Fawaz Haji Barakat Barakat

Toowoomba kebab shop owner Fawaz Haji Barakat Barakat was caught drink-driving on his way to work about 12.40am on June 25.

At the Toowoomba Magistrates Court on August 8, the 25-year-old pleaded guilty to driving over the middle alcohol limit but not over the high alcohol limit.

Police prosecutor Rohan Brewster-Webb said Barakat’s alcohol reading was 0.144.

Barakat told officers he had two scotch and Red Bull drinks before heading to the CBD kebab shop.

He was fined $750 and disqualified for four months.

No conviction was recorded.


Cannabis driving offence

Isabel Lopez

A 44-year-old woman, new to Toowoomba, has lost her licence for two years because she drove on a disqualified licence, just five days before the ban ended.

A Toowoomba court heard on Tuesday, August 30, that Isabel Lopez also tested positive for cannabis when she was pulled over on July 20.

She pleaded guilty to driving on a disqualified license and driving while a drug was present in her saliva.

The court heard Lopez was currently attending Bond University, where she studied a bachelor of business and commerce.

Magistrate Louise Shephard said it was “tragic” Lopez thought her disqualification period had finished, as magistrates had no discretion for the offence, which was subject to a mandatory two year disqualification period.

Lopez was sentenced to an additional three month disqualification for drug driving.

She was fined $880.

A conviction was recorded.
