A Darling Downs man has been charged with 11 offences arising from a crash that put a four-year-old girl in hospital.
Police will allege 31-year-old Dylan Stewart MacDonald was behind the wheel of a 1992 Toyota HiLux utility that was observed swerving in and out of traffic before he lost control of the vehicle and rolled on the Warrego Highway, west of Oakey about 9.20pm on August 15.
Emergency services were called to the crash and treated Mr MacDonald, along with the four-year-old girl, who was a passenger in the HiLux.
They suffered minor injuries and were transported to Toowoomba Hospital in stable conditions.
Police will further allege that they found a fake pistol, an amount of ammunition and a quantity of methamphetamine at the scene.
Mr MacDonald is charged with a raft of offences, including driving without due care and attention, possessing dangerous drugs, possessing a modified firearm and several other Weapons Act Offences.
His matters were briefly mentioned in the Toowoomba Magistrates Court on Saturday, where they were adjourned to Monday.
On Monday police prosecutor Chris Willson said he was made aware Mr MacDonald could not attend court as he remained in hospital.
“It was indicated he is likely to be still in hospital at least until the end of the week,” Senior Constable Willson said.
“He’s never made the watch-house, he’s never actually been formally lodged in the watch-house; he’s been in hospital since the time of his arrest.”
Nathan Bouchier, appearing as friend of the court, requested an adjournment to inquire as to Mr MacDonald’s representation going forward.
“I have not got any instructions,” Mr Bouchier said, adding he was unaware if Mr MacDonald intended to proceed with private legal representation or otherwise.
Mr MacDonald is next due to appear before Toowoomba Magistrates Court on 26 August via videolink.
