Dylan Charles Green’s youth and lack of criminal history saves him from actual jail time after facing Toowoomba Magistrates Court

A 24-year-old Toowoomba man knocked out another person outside a Toowoomba club, but was not jailed. Here’s why.

A 24-year-old man who knocked out another man outside a Toowoomba club during a drunken tirade has narrowly avoided being jailed.

Dylan Charles Green was sentenced to 18 months’ jail after pleading guilty to a charge of grievous bodily harm but Judge Michael Williamson KC ordered he be released immediately on parole.

Crown prosecutor Ben Jackson told Toowoomba District Court at the time Green was working as a bar attendant at Club Toowoomba but was not working on the night of June 6, 2021, but drinking with his parents.

At 9pm when the bar closed, the trio had gone outside where Green’s mother got into the driver’s seat of her car prompting another man who walk up and berate her for driving while under the influence.

The woman said she was just turning over the engine to put the heater on but the complainant continued to tell the woman not to drive leading to an argument between the four people, Mr Jackson said.

A push and shove initially between Green’s father and the other man prompted Green to step in and eventually he pushed the man back who fell to the ground, hitting his head and rendering him unconscious, he said.

The victim sustained a fractured skull and bleeding on the brain which left him in the Princess Alexander Hospital in Brisbane for 11 days, the court heard.

Due to his injuries the man was not able to work as a ride share driver but had obtained some other work for some months, Mr Jackson said.

The victim, who was in court for the sentence hearing, had made a good physical recovery but still had some health issues, he said.

Green’s barrister Frank Martin said his client was remorseful and had written a letter of apology to the complainant.

His client had called to someone to call an ambulance and had waited and helped load the complainant man onto a stretch and into the ambulance, he said.

His client was working and was in a supportive relationship, Mr Martin submitted.

Judge Williamson noted all concerned in the incident were intoxicated but the offence was “very serious”.

“It should be made clear that the community does not tolerate alcohol fuelled violence,” he said.
