Drunk patron spat in face of bouncer evicting him from bar

The man had turned to drinking alcohol after the death of his partner but his solicitor said he had no excuse.

A 27-year-old man has been fined $650 for spitting in the face of a security officer evicting him from a Toowoomba nightclub.

Benjamin Jason Luke Stokes was being held on the ground outside the Vault on Ruthven when police arrived on the night of April 17.

Police prosecutor Shelby Larcombe told Toowoomba Magistrates Court Stokes had been evicted but refused to go and then spat in the face of the security officer escorting him.

He pleaded guilty to common assault.

His solicitor Ryan McCullough said his client had been going through a difficult time after the death of his partner of five years and had turned to drinking alcohol.

After being taken to the watch house that night, he had been taken to the Acute Mental Health Unit, he said.

He had since stopped drinking, Mr McCullough said.

Magistrate Howard Osborne ordered the conviction was not recorded.
