A Toowoomba man who told police he had drunk one and a half bottles of wine before driving unsurprisingly had a blood/alcohol level more than four times the legal limit.
Dhieu Geu Warabek was pulled over for a licence check and random breath test by police patrolling David St, Rockville, about 2pm, June 21, Toowoomba Magistrates Court heard.
When the breath analysis machine malfunctioned, the 37-year-old was taken to Toowoomba Hospital where a sample of his blood was taken for testing, police prosecutor Leea Trewin told the court.
A certificate was returned from the government laboratory showing Warabek at the time had a blood/alcohol level of 0.234, Senior Constable Trewin said.
The self represented Warabek pleaded guilty to driving while under the influence of liquor.
He told the court “things fell apart” after his marriage broke down and he had been homeless for a time.
However, he was now living with a friend and had stable accommodation, he said.
Acting Magistrate Roger Stark fined Warabek $1200 and disqualified him from holding or obtaining a driver’s licence for seven months but ordered the conviction not be recorded.
