Chloe Lee Cubby caught smuggling suboxone strips into boyfriend in jail placed on probation

A 36-year-old woman caught trying to smuggle drugs into her “controlling” boyfriend in prison has been placed on probation.
Chloe Lee Cubby was caught by security trying to smuggle 160 suboxone (buprenorphine) strips into her boyfriend who was serving a sentence in Borallon Training and Correctional Centre at Ironbark on March 19, 2023, Toowoomba District Court heard.
Prosecutor Cameron Francis told the court Cubby had no previous criminal history but her then partner had a “very significant” criminal history.
Cubby’s barrister Frank Martin, instructed by solicitor Claire Graham of Skuse Graham Lawyers, told the court his client’s then partner was “controlling of her” but she had now severed ties with him and wanted nothing to do with him.
Cubby suffered anxiety and post traumatic stress disorder arising from a car crash in which she was the driver and a 15-year-old boy had died.
She had spent three months in hospital after the crash, he said.
Some family members of the deceased teenager blamed Cubby for his death and she had been assaulted by family members at Clifford Gardens and again at Grand Central shopping centres, he said.
Mr Martin said his client was afraid to go outside her home as a result.
“She’s virtually a prisoner in her own home,” he submitted.
Judge Paul Smith said he accepted that Cubby’s then prisoner partner was controlling of her and she feared repercussions if she did not adhere to his requests.
Judge Smith placed Cubby on 12 months probation to include medical and psychological support.
