A Toowoomba woman and her young children woke in the dead of night to a man trying to get into their home, however when police arrived they realised it was not the usual trespass crime.

A Toowoomba court was told officers found Aiden Travis Rigby about 2.15am laying in the woman’s yard, grossly intoxicated.

The woman and Rigby had never met before.

Police prosecutor Natalie Bugden said Rigby’s friends arrived soon after police and told officers they were drinking at the Wilsonton Hotel, where the 23-year-old had drunk about 15 beers.

They also told police Rigby was involved in an alleged fight at the pub on August 18, before he took off on foot.

Sergeant Bugden said Rigby’s mates tried to help police calm him down, but he was extremely aggravated and uncontrollable.

The Queensland Ambulance Service had to be called, and paramedics were forced to sedate him.

However once at the hospital, Sergeant Bugden said Rigby treated hospital staff in the same manner and was again sedated.

The court was told the earthmover labourer, and young dad, recently moved to Toowoomba from Melbourne after his relationship broke down, which is what led to his excessive drinking and heightened emotional state.

In Toowoomba Magistrates Court on Friday, September 8, Rigby pleaded guilty to trespass, obstructing police while intoxicated in public, and public nuisance.

Acting magistrate Rowan Silva accepted his family problems may have led to the blow-up, however it was no excuse for his irrational and unacceptable behaviour.

Mr Silva told the young dad he was pleased to hear he had not drunk alcohol since the incident, and urged him to consider giving it up completely.

Rigby was fined $550, and ordered to complete 40 hours of community service.

No conviction was recorded.
