Voicemail messages left by alleged killer Justin Stein to mother of schoolgirl Charlise Mutten played to jury

A jury has heard a slew of voicemails left by an alleged killer to his former partner, where he can be heard saying he has his “f**king guns” and is “going to kill” her.

The man accused of killing nine-year-old Charlise Mutten made a barrage of phone calls to the girl’s mother threatening he was going to kill her with his “f**king guns”, a jury has heard.

The jury presiding over Justin Laurens Stein’s NSW Supreme Court trial at Parramatta was played the confronting audio snippets sent by the 33-year-old to his former partner on Wednesday.

He is accused of murdering the nine-year-old, the daughter of his former partner Kallista Mutten, at a property owned by his parents before dumping her body in a plastic barrel near the Colo River area.

Mr Stein has pleaded not guilty to the murder, but has admitted to disposing of the nine-year-old’s body.

The girl spent her time in Sydney split between Mr Stein’s family property at Mount Wilson, where she was allegedly shot and killed, and at a caravan park named the Riviera Ski Gardens in Lower Portland, about 1.5 hours away.

On January 11, 2022, crown prosecutor Ken McKay SC told the jury Charlise had travelled back to Mount Wilson from the caravan park with Mr Stein, while Ms Mutten stayed behind.

Mr McKay alleges Mr Stein was the “last person” to see Charlise and had the opportunity to her between 7.16pm on January 11 and 10.06am on January 12.

The jury was told Mr Stein went and retrieved Ms Mutten from the caravan park later on January 12, with the mother under the impression Charlise was unwell and being looked after at the Mount Wilson property.

Ms Mutten had called two local hospitals to find out if her daughter was there on the night of January 12, before the pair went to sleep.

During the night, the jury was told Ms Mutten went through Mr Stein’s phone and saw he had been accessing adult dating sites which caused her “distress”.

In the early hours of January 13 Ms Mutten took Mr Stein’s Holden Colorado ute and went to a nearby park where she sent messages to friends “consistent with her belief the child was missing”, Mr McKay said.

“I’m devo and now my daughter is missing,” one message read.

When she later returned to the property she sent a message to Mr Stein saying “I just want my daughter”.

The jury was told there was a “confrontation” between the couple at the house before Ms Mutten again took off in his car.

While she was gone, Mr Stein left eight messages on Ms Mutten’s phone telling her to bring his car back.

“Bring back my car now, I’m saying this only once, if you don’t bring it back I am going to f**king hurt you as well as everyone else, and I’ll tell the police you’re the one who took your daughter so they will bring back my f**king car,” the recording, which was played to the jury, said.

The jury heard another voicemail where Mr Stein said: “Guess what, the other car just started c**t”.

It continued: “I’ve got my f**king guns and I’m going to f**king kill you now, and I’m f**king serious, you’ve f**ked me over for the last time...it was you doing this to Charlise to f**k me wasn’t it c**t, I’m going to kill you.”

In another message, Mr Stein tells his then-fiancee he “does the right thing” by “looking after” her.

Meanwhile, he can be heard saying in another message “have fun, between everything I can put on you, you’re going down dog”.

MUM’S TRIPLE-0 CALL

Earlier in the day the jury was played the Triple-0 call by Ms Mutten, who reported her daughter missing on January 12, 2022 at 8.12am.

Charlise had already been missing for two days when Ms Mutten made the phone call, the jury was told.

The recording opened with Ms Mutten crying as she told the triple-0 operator she was reporting a missing child.

“I’m sorry, I need to report my daughter missing … she’s nine,” Ms Mutten tells the officer through tears.

She tells the police her address before the officer asks when the last time Ms Mutten saw her daughter.

Ms Mutten, still crying, said “two nights ago”.

The officer asks where Charlise went two nights ago.

“She was here (the Mount Wilson property) … I wasn’t here, my partner was here and during the morning she was really … she was sort of sick, lethargic, and I was two-and-a-half hours away,” Ms Mutten said.

“Justin and the lady that came over to do the auction for his mum … he asked if she could mind her while he went and got me because he didn’t want her in the car because she’d been throwing up.”

Ms Mutten told the officer the woman told Mr Stein to “take his time” but when they arrived there was no one in the house.

“I rang all the hospitals,” Ms Mutten explained.

In the recording, Ms Mutten was asked if the morning before the phone call was the last time Charlise was seen and she explained that she had been “looking for her in the bush” which is why it took two days to report her daughter missing to police.

When asked by the officer if Ms Mutten had any thoughts were her daughter may have gone, she could be heard breaking down on the phone.

“No … she’s here on holidays for a month with me,” she said before becoming overcome with tears.

Ms Mutten continues crying as the officer informs her police will come to the property and begin an investigation into Charlise’s disappearance.

Charlise’s body was found in a barrel on an embankment near the Colo River four days after her mother reported her missing.

Mr Stein is accused of shooting the young girl before stuffing her body in a barrel.

He disputes the murder but his barrister, Carolyn Davenport SC, told the jury on Monday that her client admits to disposing of Charlise’s body.

Crown prosecutor Ken McKay SC earlier told the jury that Mr Stein had lied to Ms Mutten, telling her a woman from an auction company would take care of Charlise while he was out.

But later he told Ms Mutten the girl might have been taken by “criminal associates” from his past.

Mr Stein then told police Charlise had not been with him on the property and he had last seen her on January 10, claiming he only found out she was missing on January 14.

The jury was told Mr Stein later told a corrective services officer that he didn’t kill Charlise but was “in the vicinity when Kallista Mutten shot and killed the girl”, Mr McKay said.

Detective Sergeant Bradley Gardiner gave evidence on Wednesday, telling the court that phone data showed Mr Stein was at Mount Wilson on the night of January 11, while Ms Mutten was at his cabin at the Riviera Ski Gardens, about 1.5 hours away.

The jury was told Mr Stein sent a text to Ms Mutten on the morning of January 12 that said Charlise was staying home as she was sick.

“Am literally about to walk out the door. Charzey is staying put in bed she’s wrecked and already fallen back asleep,” the message said.

Mr McKay alleged Mr Stein killed Charlise between arriving at the home the night before and by the time he sent that text to Ms Mutten.

After his arrest in January 2022, Mr Stein denied killing Charlise in an interview with a Corrective Services officer but said he was “in the vicinity when Kallista Mutten shot and killed the girl,” the jury heard.

A toxicology report showed Charlise had tested positive for Mr Stein’s schizophrenia medication.

The trial continues before Justice Helen Wilson.
