‘Relentless phone calls’: Scott Thomas Whyte gets two years for stalking, revenge porn

A man who called his ex-partner 433 times in four days and threatened her non-stop has been sentenced to two years in jail.

A Townsville man has been sentenced for unlawful stalking and distributing intimate images, after he repeatedly tried to contact his ex-partner after their break-up and uploaded videos of her as “blackmail”.

A court heard Scott Thomas Whyte, 31, tried to call the woman 423 times over a four day period after their relationship ended.

In addition to the calls, Whyte texted her, emailed her, went to her parent’s house, and drove past on the street.

In the woman’s victim statement, she said the stalking has “affected my life in everyway” and any phone contact from Whyte would put her life on lockdown, rushing to protect herself and her family.

“My father could not leave the house when we were home in case he turned up,” she said.

“Our security cameras were never switched off and doors were triple checked.”

Crown prosecutor Patrick Newman said two days into this intense stalking period Whyte was arrested and spent time in the watch-house, but this didn’t deter him.

“He was taken to the police station, he was granted bail, and on immediately being granted bail he’s called the complainant again and resumed stalking her,” Mr Newman said.

In addition to the unlawful stalking, Whyte also pleaded guilty in Townsville District Court on Friday, April 5, to sharing intimate images on seven separate occasions, contravening a court order, and 14 summary offences.

The intimate images offences started before the couple’s break-up and continued over a 10 month period.

In her statement, the woman said the revenge porn was a “form of blackmail”.

“This is something I will never escape. These images will forever be circulating, this will not only affect my career, but my mental health. I’ve never felt so degraded, insecure and upset,” she wrote.

“The stalking and harassment I went through of relentless phone calls and texts, would never stop. At times I thought it would be easier to take my own life. I felt powerless and afraid.”

Judge John Coker said he hoped Whyte had “hated every second” of the 204 days he’s spent in jail on remand.

“More than 400 calls in four days is excessive by any standard one could possibly imagine,” Judge Coker said.

“You made the life of (the victim) hell.”

Judge Coker sentenced Whyte to 12 months in prison for distributing intimate images, six months for contravention of a court order, and 204 days for unlawful stalking.
