The man charged with the triple-fatal Greyhound bus crash will not enter any pleas on the date that was originally scheduled as the court proceedings stall.
Peter Jason Cafe appeared in Townsville District Court on Friday with new lawyers, after his Legal Aid application was finalised only the day prior.
Mr Cafe was charged with five counts of driving to cause death or grievous bodily harm after the Greyhound bus he drove in Gumlu crashed and killed three people, and seriously injured two others.
The man was originally scheduled to be arraigned on July 4.
His new Legal Aid lawyer said she appreciated that the prosecution wanted to keep that date set but said they needed time to receive the brief and files from the previous lawyers.
“It is requested that the date be vacated as an arraignment and it be listed as a mention,” she said.
Crown prosecutor Andrew Lourie said due to the “nature” of the charges there was urgency to have it moved along.
“There’s highly emotional family members who have a desire to have certainty,” he said.
Judge Gregory Lynham said the court “can’t do much” about a change of lawyers.
“It’s not a simple matter and they’ll need to take proper instructions, there is some urgency to keep the matter moving forward,” he said.
His Honour vacated the arraignment date, and changed it to just a mention where Mr Cafe’s appearance will not be required on July 4.
