Aleer Deng Aleer granted bail in Toowoomba Magistrates Court on charges of fraud, stealing and stealing of a vehicle

A 28-year-old man has faced Toowoomba Magistrates Court claiming he had clear consent after allegedly stealing $44,000 from loved ones. Find out what the magistrate had to say here.

What happens when you are charged with a crime?

A Middle Ridge man has claimed he had “clear” consent after he was charged with numerous offences, including stealing a vehicle.

Aleer Deng Aleer, 28, appeared in Toowoomba Magistrates Court via webcam from the watch house on Tuesday after he was charged with one count of fraud – dishonestly obtains property from another, one count of stealing, and one count of stealing of a vehicle.

Police allege Mr Aleer stole $44,000 from “persons that have been helping and assisting him in life” over a two-month period reportedly last year.

Police prosecutor Rowan Brewster-Webb told the court Mr Aleer allegedly stole a motor vehicle belonging to a family member, which he then subsequently sold off, in December last year.

Mr Aleer’s solicitor Jag MacDonald of MacDonald Law told the court his client contested the claims, claiming “there were clear consense given … in relation to the charges of the $44,000 in bank transfers”.

In addition, Mr MacDonald said his client was able to provide a “contract of sale” of the allegedly stolen vehicle.

Mr MacDonald said his client, who works as a driller, has been employed for some time, and has the assistance of his family.

Ultimately, magistrate Lisa O’Neill said Mr Aleer’s “criminal history is certainly significant for a person of that age”, and she was confident conditions would me made to limit the risk of Mr Aleer reoffending.

“The reality is, he’s on his last chance,” she said.

“If he comes back in, the results are probably going to be … different.”

Magistrate O’Neill granted Mr Aleer bail, under the condition he remained living with his family, reported to police Monday and Thursday weekly, and must not approach or have someone else approach the witnesses to the alleged crimes.

Mr Aleer’s case will be mentioned in Toowoomba Magistrates Court on November 8.
