Suzi Milgate makes new application for bail

Nearly a month into her behind-bars experience, the former real estate agent was sporting prison orange as she put forward a new application for bail.

Suzi Milgate has been granted bail after spending 24 days behind bars.

The former real estate agent had been in custody since November 8 after she allegedly drove over the foot of a worker who was in the process of repossessing her BMW at Humpty Doo.

The worker was waiting for a tow truck to arrive when Ms Milgate allegedly showed up, got behind the wheel and took off.

Before she hit the pedal, police say a nearby resident tried to wave her down, telling her the worker had a right to repossess the car.

As the 58 year-old drove off, police allege she crunched the worker’s foot.

She was arrested and charged with aggravated assault, recklessly endangering serious harm, driving unregistered and driving uninsured.

Her first attempt at bail was shot down a few days after the incident by Judge Ben O’Loughlin, who said he did not have a “high degree of confidence” she would obey court orders.

After more than three weeks behind bars, Ms Milgate reappeared at Darwin Local Court - this time via video link - on Monday to have another crack at bail.

Sporting an orange jumper, Ms Milgate sat quietly in her cell as her application was discussed.

Her lawyer, Abirami Rajkumar, said her client’s jail experience was excessive.

“That is a significant period of time for someone who hasn’t been in custody before.”

Ms Rajkumar said her client suffered from post-traumatic stress disorder and anxiety, and her condition was worsening behind bars.

She maintained bail would allow Ms Milgate to undergo proper treatment.

The court did not hear if the matter would be contested, however Ms Rajkumar acknowledged “there’s a long way to go”.

Presumption was against bail, with the prosecution also questioning the legitimacy of Ms Milgate’s mental health claims.

“The document from the Palmerston GP clinic does not support any form of diagnosis,” they said.

However, the prosecution conceded they did not consider Ms Milgate a flight-risk nor would a tracking device be necessary if bail was granted.

Judge Jonathan Bortoli granted bail on the condition Ms Milgate did not contact the alleged victim, she self-report to police once a week and pay a $1000 recognisance.

“Thank you,” Ms Milgate said.

Her matter will return to court on January 19, 2026 for a directions hearing.

The court heard body-worn footage as well as footage taken from a witness purportedly capturing the alleged offence would potentially be reviewed.
