A predator is behind bars after she abused a blacked out teenage boy at a party, before telling him “he wanted it too” when he confronted her.
A jury found Cynthia Marion Jean Frahn, 53, guilty of indecent assault and unlawful sexual intercourse after a trial in the District Court last month.
During the trial, prosecutor Christine Hanna told the court the 16-year-old victim was at a party.
The court heard Frahn began making intense eye contact with the victim before they ended up alone together.
“The accused approached (the victim) and told him that he was ‘innocent’ and ‘irresistible’ and that she thought about him while she used her vibrator,” Ms Hanna said.
“She also said that she would f*** him in a heartbeat.”
The court heard the party continued before the victim “blacked out” and woke to Frahn kissing him.
Frahn then pulled down the victim’s pants and began sexually abusing him, while he lay in shock.
“He began breathing heavily as he thought he was having a panic attack,” Ms Hanna said.
The court heard the victim said he needed to get some water before telling his friend what happened.
Frahn’s DNA was found at the scene.
In her closing submissions, Ms Hanna said the victim’s state of drunkenness must have been obvious to Frahn.
“(The victim) said he wished he pushed her off but he was just frozen,” Ms Hanna said.
“As the fellatio continued (the victim) said … ‘this isn’t happening. This isn’t happening’.
“And he also said ‘This isn’t okay … you are married.”
The court heard when the victim confronted Frahn online about the abuse she replied that “he wanted it too”.
Kathryn Waite, for Frahn, tried to argue that DNA can be transferred from place to place and that it was just the victim’s word as there were no witnesses.
Ms Waite said Frahn couldn’t explain why the victim would “make things up”.
“Was there simmering jealously between (the victim) and the Frahns? Was he wanting attention from his peers in some way?” she said.
After the jury verdict Frahn’s bail was revoked and she will face sentencing submissions next month.
