Tyrese James Kennedy sentenced in Proserpine Magistrates Court for break and enter

A young man has again broken into a private home in the Whitsundays to steal alcohol, just weeks after he was caught trespassing.

A 20-year-old Whitsundays man has again snuck onto private property to steal alcohol, just weeks after he was caught trespassing.

Proserpine Magistrates Court heard Tyrese James Kennedy and an accomplice broke into the downstairs area of a two-storey home along Telia St in Propserine at 11pm on June 29.

Police prosecutor Sergeant Emma Myors said they twisted the lock and damaged the door latch to gain entry.

Sergeant Myors said the occupants of the house were woken up when a CCTV camera installed on the property triggered an alarm.

She said police officers arrested Kennedy shortly after midnight but he would not cooperate and had to be restrained as officers transported him to the watch-house.

Kennedy told police he had entered the property as he was “aware there would be alcohol in that room”.

It is not the first time the Proserpine man has been caught stealing alcohol. In September 2021, Kennedy stole beer from an 83-year-old woman’s fridge, as well as a CCTV camera which he threw in a rubbish bin but without destroying the evidence.

Sergeant Myors said Kennedy had further trespassed onto a different Proserpine property on a date between May 26 and 30 this year after losing his phone there, ignoring the property owner’s instructions that he could get his phone back after she returned from a weekend away.

The court further heard Kennedy had broken his bail conditions twice during September as he was caught drinking with blood alcohol concentrations of 0.193 and 0.213.

Aboriginal Torres Strait Islander and Legal Service solicitor Philip Moore said Kennedy had a known alcohol problem, which led to his offending.

Mr Moore said Kennedy was working on it with Corrective Services but that “Rome wasn’t built in a day”.

Kennedy pleaded guilty to obstructing a police officer, two counts of entering a dwelling and commit, and two counts of breaching bail conditions.

Acting Magistrate Jennifer Batts sentenced him to 12 months probation and recorded convictions.
