A North Queensland man who allegedly reoffended days after he was arrested for being a public nuisance has defended his case for bail.

A Whitsundays man who allegedly reoffended days after he was arrested for being a public nuisance has defended his case for bail.

Ronald Wyder Obee Daniel, 34, has been arrested for wilful damage only a week after he was arrested for the first time for being a public nuisance.

The alleged offending occurred seven days apart, the first time in Proserpine and the second time in Cannonvale.

Mackay ATSILS solicitor Philip Moore told the court there was a change in Daniels’ circumstances as he had already spent 10 days in custody and was at risk of spending too much time if not released on bail.

Mr Moore told the court this meant Daniel was no longer an “unacceptable risk” to the community.

He also told the court Daniel’s sentence was not likely to involve any time of imprisonment.

Police prosecutor Sergeant Emma Myors told the court Daniel’s time in custody was no excuse to grant him bail as the court had already ruled the risk of his reoffending was too high, when he was remanded in custody on June 15.

She said defence had not presented to the court any evidence that would indicate to the court Daniel was not a risk to the community anymore.

Magistrate Michelle Howard refused Daniel’s bail and ordered he be remanded in custody until the next mention on July 29.
