Amy Melissa Dobinson guilty of assault after spitting on landlord

A woman admitted to spitting on her landlord after he attempted to evict her and a boyfriend, but told police the landlord attacked him with a sword and got stabbed instead.

A landlord was woken from his sleep and assaulted by a disgruntled tenant after he told her not to come back to the residence she lived in.

Amy Melissa Dobinson appeared in Bowen Magistrates Court on 13 May charged with common assault over the September 4 incident, in which she was also punched in the face.

The court heard Ms Dobinson and her then partner were asked to leave a rental property by the landlord, who said he was changing the locks and they would need permission to collect any property. The boyfriend was not charged with any wrongdoing.

The landlord said he was in bed asleep when he heard someone enter the home.

When he got up and went to the living room he saw Ms Dobinson who began shouting at him.

It was alleged her partner was seen upstairs throwing things around so the landlord began making his way upstairs where an alleged physical altercation took place.

The court heard the landlord made his way downstairs where Ms Dobinson continued shouting at him and spat in his face.

The landlord told police he punched Ms Dobinson in the face to get her away from him.

It was alleged another physical altercation took place between the landlord and Ms Dobinson’s then partner where the landlord was allegedly stabbed in the upper arm, the court heard.

At around 8.30pm that day, Ms Dobinson and her then partner reported to police that her landlord had kicked them out of the property and while they attempted to retrieve their belongings the landlord attacked them, punching Ms Dobinson in the face before striking her partner in the head with a sword.

Police prosecutor Sarah Rowe noted police did not observe any injuries to Ms Dobinson and a minor laceration to the top of her partners head.

Police then received a triple-0 call from a witness located in a neighbouring property seeking assistance for the victim who had a stab wound.

The court heard the incident occurred while Ms Dobinson was on parole.

Solicitor Cleo Rewald of Richard Rewald Solicitors appeared on behalf of Ms Dobinson telling the court while there was a lot of narrative around the events of that night and the other parties involved, her client, while present, was not a party to any of the incidents other than the spitting.

She told the court Ms Dobinson could not have envisaged what would transpire while trying to remove her belongings from the property that night.

Ms Dobinson plead guilty to the single assault charge.

Acting Magistrate Haydn Stjernqvist sentenced her to 18 months under supervision of probation officers.

A conviction was recorded.
