A Whitsundays woman who has faced a court for not being compliant with housing standards, has told a magistrate she wants to try everything to save her mum’s house from being demolished.

Jennifer Maureen Tinker was facing the Proserpine Magistrates Court after receiving a notice to appear for breaching an enforcement notice.

Estate Planning Law Specialist Daniel Purtell, who was appearing on behalf of the Whitsunday Regional Council, told magistrate Michelle Howard the notice had been issued as Ms Tinker had not done works required by the town plan at her property.

When asked by Magistrate Michelle Howard if she wanted to contest the charge, Ms Tinker responded she had no other place to go.

“I have to do something, otherwise I will be on the street your Honour,” she said adding that council wanted the house demolished.

“This is my home and I plan to save it your Honour.”

Ms Tinker told this publication outside of court she had inherited this house from her mum when she passed away two years ago.

She said the issue was that she had not managed to get her house certified.

“They need to do an investigation, see if the footings are fine, check all the plumbing, check all the electricity [ …] and then final approval,” she said.

“My builder said he could do it for 40 to 60 thousands dollars and now he’s backed out.

“I’ve been trying to find someone to do it, but no one wants to have a go at it.

“Builders prefer to work on a brand new place, some of them don’t mind doing extensions and fixing things up but you got to find the right guy”

“And how do you find the right guy?”

Ms Tinker said she was told by a builder that demolishing the house and rebuilding a new one would cost $1.3 million.

“This is a beautiful house, you should have a look at it and it is just a shame that it has to be torn down,”

She told the court she would seek further legal advice.

Her case will be mentioned next in court on April 15.
