Warwick court: Mother breaches domestic violence order with series of belittling texts to ex

‘You’re a s--t father’: The woman hacked her daughter’s iPad in a sneaky effort to lash out at her ex and his new partner in a series of belittling texts.

A Warwick mother who was driven to using her daughter’s iPad to send a series of abusive messages to her ex and his new partner has faced court for breaching a domestic violence order.

Police were called to a Warwick home at about 8.30pm on June 11, where the woman’s ex told officers his new partner was sent a series of messages by the other woman under his name.

Warwick Magistrates Court heard the 30-year-old, who cannot be named, used her ex’s account on the iPad he’d given their daughter to send the messages.

Police prosecutor Ken Wiggan said the conversation was initially about the couple’s child, which was allowed under the existing domestic violence order, but it eventually escalated to comments such as “you’re a s — t father”.

“He asked (her) to not use his iPad account or text him or he’d call the police, (and) he changed the password on the iPad to make sure she couldn’t do it,” Sergeant Wiggan said.

“He then received 21 messages on his phone because their daughter couldn’t watch Netflix.”

Sergeant Wiggan said police officers went to the woman’s home about a week later to query whether she understood the order and why she’d violated it, at which point she became angry and argumentative.

Defence lawyer Hamish Chapman said the woman’s frustration was sparked because her daughter had autism, which meant not being able to keep the routine of unwinding with Netflix was “very stressful”.

“While on reading the facts that might sound quite trivial and the response disproportionate … it doesn’t go so far as to explain the offending, but it goes to explain why she did what she did,” Mr Chapman said.

“She’s also dealing with some mental health concerns such as depression, anxiety, and Tourette’s that prevent her from handling stress well.”

The Warwick woman pleaded guilty to one count of contravening a domestic violence order.

She was placed on a six-month good behaviour bond and no conviction was recorded.
