A Townsville man charged with raping a child almost 25 years ago had his matter heard in Kingaroy District Court.
The 46-year-old man, who cannot be named for legal reasons, was charged with one count of indecent treatment of children under 16, one count of rape and one count of engaging in penile intercourse with a child under 16 and above 12.
The alleged incidents occurred in 2000 and 2001.
No pleas have been entered, and the defendant is on bail.
His lawyer, who appeared over the phone on Monday, May 12, told the court they had received “all the material” they requested last week, which included police disclosures from a number of alibi witnesses.
However, he said the defendant had recently informed them he could not afford to pay for his legal defence and would need to apply to legal aid, which could delay proceedings.
Judge Heaton reminded the court there was a complainant waiting for the case to move forward and he wanted the matter to be progressed as quickly as possible.
“There is a complainant, in what I understand to be historical sex matters, waiting in the wings and all of the machinations with funding and processes with legal aid to approve grants are of less consequence to me than progressing the matter in an expeditious way,” he said.
The matter was adjourned for a mention in Kingaroy District Court on Wednesday May 14, with Judge Carl Heaton telling the court he hoped the defence would have an update from legal aid.
