The lawyer for a South Burnett man facing more than 40 charges ranging from breaking and entering to possessing “hazardous” poisons claims cops don’t have a case for the “majority” of allegations.

There’s “absolutely no evidence” a South Burnett man committed the majority of crimes for which he is charged, his lawyer has told Kingaroy Magistrates Court.
Nicholas Wayne Swann, 31, faces 48 charges, ranging from breaking and entering to possessing S4 or S8 medicines or hazardous poisons as well as a number of traffic related charges.
His lawyer, Scott Sier, told the court his client would be contesting at least five of the charges and he believed there was no evidence for the majority of the remaining allegations.
“The prosecution today was supposed to decide which of the 45 matters they were going to run,” Mr Sier said.
“There is 40 where there is just, to put it bluntly, there is absolutely no evidence implicating him whatsoever.”
The court heard Mr Swann, who did not appear in court, was in custody on other charges until July 27, when he was due to be released on parole.
The case was adjourned until May 12 for a mention, with a multi-day trial due to start later this month.
