A Central Queensland miner with an eight-page criminal record who is accused of glassing his former partner in the face after an argument at a Rockhampton pub has been granted bail.

Zachary Wayne Thomas Weldon, 39, has been charged with one count of grievous bodily harm.

He was granted bail by Rockhampton Magistrate Grace Kahlert, with conditions he wear a GPS tracker ankle device, not consume alcohol, have no contact with the alleged victim and be prohibited from entering Rockhampton.

Police allege Mr Weldon picked up a schooner glass and smashed it in his former partner’s face as she walked past to leave the Oxford Hotel on Friday, October 21.

Police prosecutor Senior Constable Sarah Rowe told the court the alleged victim had surgery as a result of her injuries.

Defence lawyer Ashley Reynolds said her client instructed he had still been in contact with his former partner since they separated and on Friday, she contacted him, “asking him to come around and stay at the Empire Hotel where she was residing with her children”.

“He paid $100 for half of the room,” Ms Reynolds said.

She said her client instructed the pair decided to go to the hotel together, without the children, for drinks and that he would stay over afterwards.

“However, at the Oxford, there was an argument and he tells me that she started assaulting him,” Ms Reynolds said.

She told the court she had not yet seen the CCTV footage from the alleged incident, only screenshots.

Ms Reynolds said the allegations before the court suggested the alleged victim was attempting to “walk away at which point he has grabbed the schooner glass and smashed it against the side of her face”.

She said her client instructed he denied “pushing her off her chair” and alleged there was “serious provocation” leading up to the glassing.

The court heard police had at least five witnesses that would provide statements about events leading up to the alleged glassing.

Ms Reynolds said her client resided in Blackwater, working at the Blackwater mine, and only travelled to Rockhampton to visit his mother and sister, who were in the back of the court during the bail application.

She said Mr Weldon advised he had a problem with alcohol and had begun counselling.

Senior Constable Rowe said the injuries sustained were “significant” and required surgery.

“This isn’t a simple punch to the face,” she said.

“This is a glassing in a public place in front of many people.”

Senior Constable Rowe said his criminal record showed he had failed to address his offending behaviour.

“I would submit that he is at risk of interfering with the witness or endangering the safety of her,” she said.

Magistrate Kahlert said Mr Weldon had an “unenviable criminal history” and had been sentenced to 14 days prison only days prior to this alleged offending.

Mr Weldon’s matters were adjourned until December 7 and he was released on bail.
