Woman faces Yeppoon Magistrates Court after posting a naked pic of her ex-partner on Facebook

A Central Queensland woman has faced court for her offending which embarrassed the victim, as the post was up long enough for numerous other people to take screenshots of it. Here’s what happened.

A Capricorn Coast woman has faced court after she posted a naked photo of her ex-partner on Facebook.

The 45-year-old woman pleaded guilty in Yeppoon Magistrates Court on April 21 to contravening a domestic violence order.

Police Prosecutor Courtney Brown said on February 23, the aggrieved man attended a police station to report a breach of the order.

“The (man) stated that the (woman) had posted a naked photo of (him) on Facebook with a caption,” Ms Brown said.

Ms Brown said when police questioned the woman about the photo, she laughed and said she had done it because the man was continuously calling her and harassing her.

The court heard that the woman had a “short” criminal history.

Ms Brown told Magistrate Jason Schubert that this was a “serious breach” and the woman seemed to have not taken it seriously.

“It (the offence) is embarrassing - it exposes the aggrieved,” Ms Brown said.

“It (photo) is put out there on the internet for the world to see - you can’t get it back, if it’s out there it’s out there.”

Ms Brown submitted that a period of probation was in order.

Solicitor Ashley Reynolds said the woman posted the photo of her ex-partner “in the heat of the moment” and she “immediately regretted it.”

“She thought it was stupid and she pulled it (photo) down,” Ms Reynolds said.

“However, in the space of time that it (photo) was up there (on Facebook), it was screenshotted by a number of the aggrieved’s family members.”

Ms Reynolds said the woman was a mother, she was embarrassed about what she had done, and she had apologised directly to the victim.

Before handing down penalty, Mr Schubert told the woman she was lucky that she had not been charged with a “far more serious offence.”

“How would you feel if an intimate picture of yourself was placed on the internet?” Mr Schubert asked the woman.

She replied: “Embarrassed.”

Mr Schubert then said: “When police come around, you did chuckle at them. I’m satisfied the offence is a serious breach and needs to face a more serious consequence than a fine.”

Mr Schubert noted the woman had no domestic violence breaches on her history before placing her on probation for six months with conditions.

A conviction was recorded.
