A teenage dad was “very drunk” when he launched a beer bottle at a police car before destroying a hospital phone in a fit of rage.
Jake Kahu Clem Mclaren, 19, pleaded guilty in Biloela Magistrates Court on April 20 to charges of obstructing police and wilful damage.
Police Prosecutor Sergeant Kevin Ongheen said about 12.50am on March 9, police were called to a Biloela residence in relation to concerns about Mclaren’s behaviour.
Sgt Ongheen said upon arrival, police spoke with Mclaren’s mum on the front patio of the house.
While they were on the patio, police saw Mclaren approach a police vehicle parked at the front of the home.
Sgt Ongheen said Mclaren threw a bottle of beer at the police vehicle but missed it.
“He then walked past the vehicle, grabbed the empty bottle - police attempted to speak with him,” Sgt Ongheen said.
“He was standing on the street, he was yelling out ‘C’mon you c---s!’ while shaping up to fight the police.
“(Mclaren) then threw the beer bottle which has bounced off the roof, onto the road.”
Sgt Ongheen said the officers approached Mclaren who began walking backwards on the street while continuing to yell at them.
“Police attempted to arrest (Mclaren) by restraining him - he attempted to pull away from police, causing (him) and police to fall to the ground,” Sgt Ongheen said.
Despite being told by police to stop resisting, Mclaren continued to struggle.
He was eventually restrained, placed into a police vehicle and taken to the police station.
Sgt Ongheen said police transported Mclaren to Biloela Hospital due to his behaviour, and there he was placed into a room in the Emergency Department.
“At 4am, (Mclaren) attempted to call his partner using a hospital cordless telephone,” Sgt Ongheen said.
“After the call, (Mclaren) has thrown the cordless telephone across the room, causing damage to the phone which was no longer able to be used.”
Mclaren was charged with the two offences.
In court, the prosecution did not seek restitution.
Solicitor Madison Kurtz said Mclaren was an unemployed father in a de-facto relationship, and he was receiving JobKeeper allowance.
Ms Kurtz said Mclaren was battling depression and anger management issues, and he had sought professional help for those.
“He resides with his mum and his partner resides with them,” Ms Kurtz said.
“He has found that support very helpful to him.”
Ms Kurtz said on the night of the offending, Mclaren was “very drunk” having consumed about 12 heavy beers over the course of the evening.
Ms Kurtz said it was conceded that Mclaren had “a relevant (criminal) history”.
Magistrate Philippa Beckinsale told Mclaren that he had to find other ways of dealing with his problems.
“There are better ways of dealing with it than getting yourself hammered like this and then carrying on like an idiot,” she said.
Ms Beckinsale placed Mclaren on six months’ probation with conditions and she recorded a conviction.
