An ongoing neighbour dispute exploded onto a Rockhampton street, with one neighbour grabbing a baseball bat wanting to fight.
Rockhampton Magistrates Court heard police responded to Oswald St in Allenstown about 1.30pm on June 24 after receiving multiple calls that there was an escalating argument between neighbours, with one man on the street armed with a baseball bat.
Police prosecutor Senior Constable Sarah Rowe said police arrived on scene and saw Sam Zachary Dietz, 29, holding “what appeared to be a long pole” and that he threw it into his front yard when he saw police.
Senior Constable Rowe said Dietz told police there had been ongoing issues with his neighbours in the past few months.
“While at the hospital he received a phone call from his partner stating the neighbours had been abusing her again,” she said.
Senior Constable Rowe said Dietz had returned home and found his neighbour’s partner in the carpark and approached him in an “aggressive manner” saying he wanted to fight.
She said Dietz told police he approached the man who grabbed a long metal tool from his ute and that he then went to his home and grabbed a baseball bat and came back onto the street.
She said the man told police Dietz stood in the street and shouted abuse while waving the baseball bat around.
She said video footage reviewed by police showed Dietz pacing up and down the road calling out “aggressively” to the man while waving around the baseball bat for four minutes.
“It is quite a serious public nuisance,” she said.
“It would have been quite fearful for those involved.”
Defence lawyer Felicity Davis said there had been an ongoing dispute with the neighbour and that her client was trying to move.
Dietz pleaded guilty on July 15 to one count of commit public nuisance.
He was placed on a 12-month good behaviour bond with $1000 recognisance.
A criminal conviction was recorded.
