Rockhampton prisoner calls ex-partner a ‘pushbike’ then taunts her about deceased child

A man serving time in a Rockhampton jail continued to contact his ex-partner, repeatedly calling her a “pushbike” and also taunting her about their deceased child.

The 46-year-old man, who by law cannot be named, appeared in custody and pleaded guilty in Rockhampton Magistrates Court on February 11, 2022, to five counts of contravening a domestic violence order.

The court heard the offending happened between February 18 last year and March 6 last year.

During that time, the man was in Capricornia Correctional Centre when he made contact with the aggrieved, his ex-partner.

The protection order required him to be of good behaviour towards her.

On February 18, 2021, the man called the woman and left her a message.

Part of that message was: “You don’t want to talk to me, that’s fine. I’m over everything. Come anywhere near my face in the next couple of weeks and it’s not going to be nice. Stay away from me.”

Police Prosecutor Clancy Fox said that message was threatening in nature.

Mr Fox said the offending escalated.

On February 28, 2021, the man left another voicemail message saying: “Ok, I see how it is. You’re acting like a pushbike down there in Mackay and Gladstone. If you’re being a pushbike down there I don’t care.”

Mr Fox said those comments were abusive and derogatory as the terminology “pushbike” effectively suggested that the woman was being sexually promiscuous.

Then on March 5, 2021, the man called the woman and left another message, again referring to her as a “pushbike” and asking her why she didn’t answer his calls.

He also called her a liar saying “she never had any babies and to stop going around saying that she had babies”.

He further stated the woman was “a waste of time and waste of his breath” and that he hoped “the bloke she’s with flogs her”.

On March 6, 2021, he left a message saying the woman wasn’t answering his calls because she “had a mouthful of something” and he again called her a “pushbike”.

Later that same day, he called again and the woman responded.

He asked her why she hadn’t answered his phone calls and she said “nothing’s going on”.

The man then asked the woman if she could send him some money.

He also told her: “I know you’ve been sleeping with someone else” and he continued with those allegations.

The woman replied: “Stop messing with my head. You can’t do what you’re doing to me, do you understand? Why do you say these horrible things? Why do you speak to me like that?”

The man continued with the “sleeping around” allegations and again called the woman a “pushbike”.

Mr Fox said the last and most important part of the man’s breach was when he said to the woman: “Don’t bury that baby, that so-called baby beside my Mum.”

The woman lost her temper and responded: “Don’t talk about my baby, my son, my dead son that I buried because...”

Mr Fox said it was clear the man had directly antagonised the woman by speaking about the deceased child and asserting that she shouldn’t have the child buried beside his mum.

Mr Fox said at the time of the offending, the man was in custody and he was past his parole eligibility date but had not been granted parole.

A solicitor said the man was born in Mackay and during his upbringing he had been exposed to domestic violence himself.

The solicitor said the man had completed numerous courses during his time in custody.

“He has now been in custody continuously since the 22nd of February, 2019,” she said.

The solicitor said the man had been refused parole by the Parole Board due to these offences.

Before handing down sentence, Magistrate Cameron Press told the man there were “just too many people breaching protection orders”.

He sentenced the man to three months’ jail, wholly suspended for an operational period of 12 months.

The man’s full-time discharge date is May 21, 2022.
