Jermaine William Auda jailed for assault occasioning bodily harm and depravation of liberty

A violent Rockhampton offender, who has spent a significant part of his life in prison, dragged a woman through a house, down stairs, out the front door, into a car and threatened to ‘take her away from her son’.

A violent offender, who has spent a significant part of his life in prison, dragged a woman through a house, down stairs, out the front door, into a car and threatened to ‘take her away from her son’.

Jermaine William Auda, 32, pleaded guilty on September 29 in Rockhampton Magistrates Court to three counts of assault occasioning bodily harm, one of common assault with threats and one of deprivation of liberty.

The charges are from one event on August 13, 2021.

Police prosecutor Jennifer Leech said Auda punched the victim’s nose.

She said he also forcibly dragged the victim through the house, down stairs and out the front door, pushed her into the back seat of a vehicle and punched her in the head, face, shoulders, arms and torso.

Ms Leech said Auda also threatened the victim with a knife and told her he would “take her away from her son”.

She said the victim suffered significant pain from her injuries and was taken to Rockhampton Hospital for treatment.

Her injuries included a broken nose, broken eye socket, dislocated jaw, burst eardrum, broken toe, swelling and bruising to her face, head, shoulders and arms.

Auda had a six-page criminal record which included convictions for grievous bodily harm, assault occasioning bodily harm, common assault, assault police and assault occasioning bodily harm while in company.

Defence lawyer Brendan Gimbert said Auda was the youngest of four brothers and one deceased sister.

He said despite being the youngest, Auda was still relied on heavily by his family and with his mother caring for her grandchildren including one who was recently diagnosed with lupus.

Mr Gimbert said Auda’s uncle died in July and when he went to the funeral in Mackay, it was the first time he was able to visit his sister’s grave.

“He has been in and out of custody for quite a significant part of his adult life,” he said.

Mr Gimbert said Auda had expressed interest in attending the Helem Yumba healing centre when released from prison.

He said with relation to the assaults in this case, Auda claimed he hadn’t dealt with grief properly and was in a toxic relationship which involved drugs.

Mr Gimbert said he had no explanation about the offending.

Auda was sentenced to 2.5 years prison with 42 days presentence custody declared as time served and parole set for June 18, 2022.
