Mr De Marco has also been charged with possessing drugs, unlawfully possessing a category A, B or M weapon, two counts of unlawfully possessing a category D, H or R weapon and unlawful use of a motor vehicle, in relation to a roadside stop at the corner of Aquatic Place and High Street in Rockhampton the day after the alleged murder.

Mr Fowler has been charged with one count each of possessing tainted property and drug utensils after he was stopped by police at the corner of Karraschs Road and Pialba Burrum Heads Road in Hervey Bay on November 22, 2023.

Their charges were mentioned in Rockhampton Magistrates Court on April 17 where the court heard prosecutors had sent more evidence in the mail that morning to Mr De Marco and Mr Fowler’s defence lawyers, but there was still evidence outstanding.

Neither men have entered pleas.

Mr De Marco’s lawyer, Andrew Owens, and Mr Fowler’s lawyer, Jason Grant, both advised the court they had received the partial brief of evidence.

Police prosecutor Brandon Selic said further evidence had been sent that morning by Australia Post.

“The evidence of most significance which is outstanding is the ballistic reports,” Mr Grant said.

“They’re particularly important given the suggestion that the police located the weapons in a co-accused’s (Mr De Marco) vehicle.”

Mr Selic said the reports were expected to take between two to three weeks.

Mr Owens said it was hoped the balance of the evidence would be received by the next mention of the case on June 12.

Both men were remanded in custody.
