A Yeppoon father threatened to kill his daughter after she arranged for his dog to be euthanised without his knowledge.
The 74-year-old pleaded guilty in Yeppoon Magistrates Court on February 17 to contravening a protection order.
The court heard the man’s offending happened on October 22 last year and the order in place involved he and his daughter with a good behaviour condition.
At 5.10pm on that day, police were called to a Yeppoon residence where the man and his daughter were involved in a verbal argument.
Police Prosecutor Sergeant Kevin Ongheen said earlier that day, the daughter had asked her dad to move out of the residence.
Sgt Ongheen said the daughter had also packed her father’s belongings and locked them inside a shed at the residence.
“The defendant has climbed over a fence to get his belongings and refused to leave the address as per the aggrieved’s request,” Sgt Ongheen said.
“The aggrieved owns the dwelling, and the defendant had been living at that address for six to seven years on and off sporadically paying rent.”
Sgt Ongheen said during the verbal argument, the man threatened his daughter, stating: “I’m not leaving, I’m going to f---ing kill you. And you can go instead.”
Sgt Ongheen said the woman then locked herself inside a shed to get away from her father.
“The defendant has tried to pry open one of the windows and get to the aggrieved before police arrived,” he said.
Sgt Ongheen said the man told police he had a verbal argument with his daughter and he could not recall exactly what was said.
Sgt Ongheen said the man understood that, as part of the protection order, he had to be of good behaviour towards the aggrieved.
After the incident, the man was arrested and released on bail.
The court was told the man had no criminal history.
Solicitor Krissy Cummins said the man accepted the facts as read in court by the prosecution.
Ms Cummins said the man had been residing in the shed at the back of his daughter’s property.
“He had a dog that he was very close to,” Ms Cummins said.
“...his daughter was of the opinion that the dog ought to be put down because it was getting old and in fact, she did so without his consent when she was up visiting on an occasion.
“And that was the trigger for the argument that, ultimately she asked him to move out.”
Ms Cummins said the man no longer wished to associate with his daughter.
Ms Cummins said when the daughter locked herself inside the shed, the man was trying to get his belongings back and “not to get back at her”.
“Since the incident he’s been homeless, living in a van,” Ms Cummins said.
“He’s a pensioner with limited funds.”
Magistrate Philippa Beckinsale noted that the man was 74 and had no criminal history, and that this was “a sad set of circumstances”.
“I know it was your expression of how upset you were and how frustrated you were, but people do kill people - they make threats and they go and do it,” she said.
“So it’s treated very seriously by the police force.”
Ms Beckinsale placed the man on a good behaviour order for six months with a $500 recognisance.
No conviction was recorded.
